Supreme Court, Texas Legislators, Once Again Completely Avoid the Real Issue
Scottsdale, AZ – Today, the U.S. Supreme Court, in a 5-3 decision in the Whole Woman’s Health v. Hellerstedt case, ruled against a Texas law that requires abortion clinic regulations.
Alexander Meluskey, a conservative candidate for the United States Senate, voiced strong opposition to this ruling, and the statute that led to the controversy, by arguing that both the State of Texas and the Supreme Court failed to address the most important questions surrounding abortion.
“This opinion from the Supreme Court is a double travesty. Completely absent from the Texas statute in question, and the Court’s opinion of it, was the U.S. Constitution’s absolute due process and equal protection requirements for every individual child.”“As they have done so many times before in these cases, the Supreme Court asserted its unreasonable ‘undue burden’ test, which focuses solely upon the supposed rights of the mother. The lawyers for the State of Texas did not in any way challenge that test. Instead, every argument Texas made was that the clinical regulations within the statute conformed to this test.” Mr. Meluskey concluded, “This has once again been wasted legislative and judicial effort. Abortion on demand continues, and will continue, until those we elect demand that every person, born or unborn, be provided equal protection under the law, as the supreme law of our land requires.”
